Derechos Emergentes: Fundamentos Teóricos y Desafíos Constitucionales

The World Congress of Constitutional Law 2026 will bring together researchers and specialists from around the world to reflect on the major contemporary challenges of constitutionalism. The congress is organized by the International Association of Constitutional Law and will be held at the Universidad Externado de Colombia in Bogotá.

The program will include plenary lectures, thematic panels, and numerous specialized workshops, providing an in-depth discussion of emerging topics within constitutional law and political theory.

Emerging Rights: Theoretical Foundations and Constitutional Challenges

This workshop, presented by Rubén García and Digno José Montalván, aims to create a space for reflection on a central phenomenon in contemporary societies: the assertion of emerging rights. In the face of cultural, political, economic, environmental, and even armed conflicts that characterize modernity, these new claims require a critical examination of their theoretical and legal foundations. Over the past decades, the study of these rights has gained relevance in national and international courts, yet challenges remain in integrating them into constitutional frameworks and precisely defining their limits. The workshop focuses, in particular, on rights related to human identity and dignity, the protection of nature and future generations, the right to a healthy environment, the right to care, and the incorporation of vulnerability and intersectionality perspectives into human rights standards.
